Waiver Notice - Incloodie Food Tour

Participant Waiver & Release of Liability

Effective Date: January 2026
By purchasing ticket(s), whether directly through Incloodie or through a third-party booking platform, and/or by participating in an Incloodie tour or event, you acknowledge, affirm, represent, and agree to the following Waiver & Release of Liability:

Voluntary Participation & Assumption of Risk

I understand that participation in an Incloodie tour involves inherent risks, including but not limited to:

Walking on public sidewalks and streets
Exposure to traffic and public transportation
Weather conditions (heat, cold, rain, etc.)
Consumption of food and beverages
Optional consumption of alcohol
Interaction with third-party restaurants, venues, and members of the public

I voluntarily assume full responsibility for all risks of injury, illness, allergic reaction, property damage, loss, or death arising out of or related to my participation. Participation is entirely voluntary and at my sole risk.

Release of Liability

I hereby release, waive, discharge, and agree to hold harmless Incloodie, its owners, contractors, tour guides, affiliates, restaurant partners, vendors, agents, and representatives from any and all claims, liabilities, damages, losses, demands, actions, or causes of action arising from:

Personal injury (including death)
Illness or allergic reaction
Property loss or theft
Negligence (whether ordinary negligence or otherwise)
Acts or omissions of third-party vendors
Acts of other tour participants

This release extends to all claims, whether known or unknown, foreseeable or unforeseeable.

Personal Responsibility

I acknowledge and agree that:

I am at least 18 years of age, or I am the legal guardian signing on behalf of a minor.
My safety is my responsibility.
I am physically capable of walking outdoors for extended periods.
I will wear appropriate footwear and clothing.
I will obey all traffic laws and guide instructions.
I am responsible for my personal belongings.
If I begin to feel unwell, faint, overheated, or injured, I will notify the tour guide immediately and seek medical attention if necessary.

Minors

If I am accompanying a minor, I accept full legal and financial responsibility for:

The minor’s conduct
The minor’s safety
Any injury or damages caused by the minor

Alcohol Policy

I agree:

Not to consume alcohol if I am under 21 years of age.
To carry valid government-issued identification if consuming alcohol.
That if I choose to consume alcohol before, during, or after the tour, I accept full responsibility for my behavior and wellbeing.

I understand that intoxication may result in removal from the tour without refund.

Food Allergies & Dietary Risks

I understand:

Incloodie does not control food preparation at partner restaurants.
Cross-contamination may occur.
Allergen-free environments cannot be guaranteed.

I agree to:

Disclose all allergies and dietary restrictions prior to tour start.
Communicate directly with restaurant staff if necessary.
Accept full responsibility for any allergic reaction, foodborne illness, or related health condition.

Participation in tastings is optional and at my sole discretion.

Tour Guide Authority

Incloodie reserves the right to remove any participant who:

Is intoxicated
Is disruptive
Poses a safety risk
Refuses to follow instructions

Removal may occur without refund.

Third-Party Vendors

I understand that restaurants, bars, and venues visited during the tour are independently owned and operated. Incloodie is not responsible for:

Acts or omissions of these establishments
Food preparation practices
Service quality
Injuries occurring on their premises

Force Majeure

Incloodie is not liable for delays, changes, or cancellations resulting from:

Acts of God
Natural disasters
Government orders
Civil unrest
Pandemics
Strikes
Utility failures

Media Release

I grant Incloodie an irrevocable, perpetual, royalty-free, worldwide right to:

Photograph
Film
Record
Use my image, likeness, voice, or statements

for promotional, marketing, and commercial purposes without compensation. If I do not wish to be photographed or recorded, I must notify the tour guide before the tour begins.

Indemnification

I agree to indemnify and hold harmless Incloodie, its contractors, guides, affiliates, and partners from any claims arising out of:

My participation
My negligence
My violation of this agreement

Governing Law & Arbitration

This Waiver shall be governed by the laws of the State of Texas. Any dispute related to:

Website use
Tour participation
Products purchased
This Waiver

shall first be submitted to mediation in Dallas County, Texas. If unresolved, the dispute shall proceed to binding arbitration in Dallas County, Texas under the rules of the American Arbitration Association. The arbitrator’s decision shall be final and may be entered in any court of competent jurisdiction.

Severability

If any provision of this Waiver is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

This Participant Waiver & Release of Liability constitutes the entire agreement between myself and Incloodie regarding participation and supersedes all prior agreements or representations.

Digital Agreement

By purchasing a ticket at checkout and/or by participating in an Incloodie tour, I acknowledge that:

I have read this Waiver in full
I understand its contents
I agree to be legally bound by its terms
